Abbottsford is a planned community, and is governed by the Abbottsford Homeowners Association, as set forth in the Amended and Restated Declaration of Covenants, Conditions and Restrictions and Bylaws, recorded on December 4, 1989. (Documents are available on the Abbottsford Homeowner Portal. See page 3 of this Directory for information on how to access these documents.) EACH HOMEOWNER IS REQUIRED TO ABIDE BY THESE DOCUMENTS. All homeowners are encouraged to read these documents carefully and to be informed regarding their contents. The following rules and regulations have been adopted by the Abbottsford Board of Directors to ensure the peaceful and equitable use of Abbottsford facilities by all its residents.
DELINQUENCY POLICY
The monthly maintenance fee is due on the first day of the month. If postmarked after the 10th of the month, it is considered late, and a $25.00 late fee will be added. For any account delinquent on the 10th of any succeeding month, an additional $25.00 will be added. Any account over 60 days delinquent will have a lien placed on the property, with the attorney and legal fees added to the account. Any owner who is delinquent in the payment of any charges is not entitled to vote at any meeting of the Abbottsford Homeowners Association or use community amenities until all charges and all penalties have been paid.

SECURITY CAMERAS
Abbottsford has partnered with Flock Safety, a national neighborhood security provider, as well as Arlo to install outdoor cameras at our neighborhood entrance and clubhouse to track cars and read license plates. This is the #1 piece of evidence police request in the case of criminal activity, such as home and car break-ins. For any questions about neighborhood security, please reach out to the on-site manager.
Trash
Wednesday is trash collection day in Abbottsford. On holiday weeks, trash collection may be moved to Thursday. Recycling is collected every other Wednesday. Please see the HubNashville calendar for up-to-date trash schedules. Place cart at least 3 feet away from other trash or recycling carts or stationary objects such as a car or mailbox. Containers may be positioned curbside and available for collection by 7AM on collection day or the night before. Containers are to be returned to the garage or enclosed area no later than the evening of collection day. MAILBOXES
In order to maintain the uniformity of the appearance and location of mailboxes within Abbottsford, the Association shall be responsible for the maintenance, repair, and replacement of all mailboxes, the cost of which shall be borne by the Association. The Association may move, remove, and/or replace any existing mailbox if, in its sole discretion, the Board of Directors determines such action to be necessary or desirable.
SIGNAGE
In order to preserve and protect the decorum of the community, all signs are prohibited on Abbott Martin Road, Vailwood Drive, the entrance to Abbottsford, or anywhere within the premises of Abbottsford, except on the days when an Owner is holding an “open house.” Signs advertising the open house that are no larger than two feet by four feet (2′ x 4′) are permitted at the entrance and on the individual homesite. Signs may be displayed in homeowners’ windows, and small security signs are allowed. Tennessee law says that HOAs cannot prohibit the display of political signs 60 days before an election. While Abbottsford in the past has encouraged that these signs be displayed only in windows, the signage rules in Abbottsford now allow political signs that are no larger than 2’x2’ at individual homesites 60 days prior to an election.
CONCEALING OF EQUIPMENT
All utility meters, air conditioning compressors, and other such equipment, shall not be visible from neighboring lots, roads, streets, or open areas.
PARKING
Each residence must include a garage which accommodates the parking of at least two (2) vehicles. To the greatest possible extent, all residents’ vehicles shall be parked in the garage. Garages shall not be converted to living space or used in any other way which diminishes the number of parked vehicles which the garage can accommodate. If the garage attached to a residence will not accommodate all vehicles owned or leased by the residents thereof, the residents’ additional vehicles may be parked in the driveway or service drive, so long as such vehicles do not block access to neighboring garages or impede access by emergency or service vehicles.
Parking spaces within the Abbottsford Common Area shall be used solely for non-resident parking, unless, upon a show of good cause, the Board of Directors grants written permission for parking a resident’s vehicle(s) in such spaces.
Overnight parking on streets within Abbottsford is strictly prohibited except with the written permission of the Board of Directors upon a showing of good cause.
1. The parking restrictions contained in Article VI Section 5 of the Declaration shall apply to all vehicles belonging to, or being operated by, owners and residents of Abbottsford, their family members, agents, employees, visitors or trespassers.
2. In addition to any other remedies available to the Association, the Association may cause to be booted or towed any vehicle parked in violation of these Parking Rules or the Declaration after one (1) prior notice of violation. The Association may give such notice by leaving a note on the vehicle or by written communication to the owner or operator of the vehicle. Any expense incurred by the Association in booting, towing, and/or storage of a vehicle shall be chargeable to both (a) the owner of the vehicle in violation and (b) if the vehicle is owned by a non-resident of Abbottsford, to the owner of the home being visited by the vehicle’s owner. Such expenses shall be in the nature of assessments, shall be subject to the lien for assessments established by the Declaration, and shall be collectible in the same manner as assessments under the Declaration.
In addition, the Association’s Board of Directors may assess fines in reasonable amounts for violations of the Declaration or these Parking Rules. Fines levied for parking violations shall be collectable in the same manner as provided for the collection of assessments under the Declaration. Guidelines for parking violation fines (from which the Board may deviate in its sole and reasonable discretion), are as follows:
First Violation: Warning letter to resident and/or vehicle Owner Second Violation: $25.00 fine
Each subsequent Violation: $50.00 fine
Temporary Parking Request – Abbottsford
PETS
No dogs, cats, or pets of any kind shall be permitted outside of the residences or an enclosed courtyard or in the Common Areas unless accompanied by the owner and except on a leash. Please remember that there is a leash law in Davidson County. All owners are requested to walk their pets on the perimeter of the property, and they are required to clean up after their pets.
BASKETBALL GOAL RULES
1. All play at basketball goals shall not begin prior to 9 AM, and must cease at 7 PM or sunset, whichever occurs first.
2. If you have a basketball goal at your home, please be sure that your children or any persons who will be using the goal are aware of this rule. 3. Basketball goals are to be located in the homeowner’s driveway. Basketball goals cannot be placed in the street, service road, or common area parking spaces.
TENNIS COURT RULES
1. Courts will be open from sunrise to sunset daily.
2. A homeowner must accompany any guest(s) in order for guest(s) to play.
3. Only regulation tennis clothes and tennis shoes are permitted. Jogging, track, and basketball shoes are not permitted.
4. Please exercise court etiquette at all times.
Your cooperation and adherence to these rules and regulations will help ensure a successful and enjoyable tennis season for everyone involved.
SWIMMING POOL RULES
1. Pool hours are from sunrise to sunset. No swimming is permitted after dark, by order of the Metro Health Department.
2. Swimmers must wear appropriate swim apparel. NO CUTOFFS ALLOWED. 3. No beverages in glass containers, nor food, will be allowed in the pool enclosure at any time.
4. NO PETS are allowed in pool area at any time.
5. No lifeguard will be on duty. SWIMMERS WILL USE THE POOL AT THEIR OWN RISK.
6. No children in diapers are allowed in the pool unless their diapers are specifically designed for pool use.
7. Children under 12 must be accompanied by an adult to ensure the safety of the children.
8. No running or rough play is allowed in the pool enclosure.
9. POOL GATE MUST BE CLOSED AND LOCKED AT ALL TIMES. Parents, please tell your children not to climb on the pool gate.
10. Do not pull or swing on the lifeline. It is a Health Department requirement, and it must be left in place. If you should find it disconnected, please replace it.
11. Only Homeowners and their guests will be allowed in the pool area. All guests must be accompanied by a Homeowner.
12. Pool regulations which are currently posted at the pool entrance will be strictly enforced. Please read regulations upon entry.
13. Please remember to have your pool key with you when you use the pool.
14. Radios and other audio devices are for individual bather’s pleasure. Please use low volume or, preferably, headphones when listening to audio devices.
15. Please refrain from shouting or using loud voices while at the pool. Remember that there are homes nearby, and neighbors could be disturbed by the noise.
16. Personal items will be removed from the pool area each Wednesday to ensure a decluttered area.
Your cooperation and adherence to these rules and regulations will help ensure a successful and enjoyable swimming season for everyone involved.
GARAGE & ESTATE SALE RESTRICTIONS
As stated in Article VI, Section Two, Item 11, Sales of personal property on the premises by “garage sales,” “patio sales,” and similar sales to the general public are prohibited, unless approved by the Board of Directors of the Association.
PROHIBITIONS ON LEASING OR RENTAL OF SITES
Houses in Abbottsford are required to be owner-occupied. Leasing or Rental of houses in Abbottsford is strictly prohibited except in very limited circumstances of hardship. Please refer to Article VIII, Section One in the Declaration of Covenants, Conditions and Restrictions, for a detailed description of these hardship exceptions, which include: (1) Death of an Owner, (2) Confinement of an Owner in a medical or nursing care facility, (3) Loss of job by an Owner, or (4) Owner’s active service in the United States Armed Services, when deployed more than fifty (50) miles from the homeowner’s site. Penalties for non-compliance
with the Leasing Prohibition will be imposed accordingly: The Board of Directors, by way of the Management Company, will notify the homeowner of any non-compliance violation. Beginning with the first day of non-owner occupancy, the owner of the property will be fined $250.00 (two hundred fifty dollars) each day that the owner fails to comply. If, after 10 days, the owner has still failed to comply, the amount of the fine will be increased by the Abbottsford Homeowners Association to $400.00 (four hundred dollars) for each day until the owner comes into compliance.
